Aarti Industriesથી Heranba, Meril, Sarna, Best Paper, Superform અને N.R. Agarwalથી Macleods સુધીના Employer Codes સામે આવ્યા; કેટલાક Code અલગ-અલગ ESIC recordsમાં ફરી જોવા મળે છે

દક્ષિણ ગુજરાતનો ઔદ્યોગિક વિસ્તાર દેશના મહત્વના industrial clustersમાંનો એક છે. અહીં મોટી કંપનીઓથી લઈને નાના-મોટા industrial establishments કાર્યરત છે. કર્મચારીઓની સામાજિક સુરક્ષા માટે Employees’ State Insurance — ESI/ESIC વ્યવસ્થા મહત્વપૂર્ણ છે.
પરંતુ ESICના સત્તાવાર Defaulter List અને Action on Defaulter recordsની તપાસ કરતાં એક મહત્વનો સવાલ સામે આવે છે—
દક્ષિણ ગુજરાત સાથે જોડાયેલા કેટલાક જાણીતા industrial establishmentsના નામ ESICના આ recordsમાં કેમ જોવા મળે છે?
Auranga Timesની દસ્તાવેજી તપાસમાં ESICના Surat jurisdictionના 6 જાન્યુઆરી 2026ના Action on Defaulter recordમાં અનેક જાણીતા establishmentsના નામ અને Employer Codes જોવા મળે છે. સત્તાવાર PDFમાં, ઉદાહરણ તરીકે, Aarti Industries, Meril Life Sciences, Vital Laboratories, Sarna Lifesciences, Superform Chemistries, Heranba Industries, Macleods Pharmaceuticals અને N.R. Agarwal Industries જેવા નામો નોંધાયેલા છે.
ESIC recordsમાં એક જ કંપની અથવા corporate groupના અલગ establishments માટે અલગ Employer Codes હોઈ શકે છે.
આથી તપાસમાં માત્ર company nameને આધાર બનાવવાને બદલે જ્યાં શક્ય હોય ત્યાં Employer Codeને મુખ્ય ઓળખ તરીકે લેવામાં આવ્યો છે.

નોંધ: ઉપરના તમામ નામો માટે exact establishment અને Employer Codeને આગળની તપાસમાં સંબંધિત દસ્તાવેજો સાથે cross-check કરવાનું રહેશે. એક જ નામ ધરાવતી અલગ entity/establishmentને એક જ કંપની માની શકાય નહીં.
આ તપાસનો મહત્વનો મુદ્દો અહીંથી શરૂ થાય છે.
કેટલાક Employer Codes અગાઉના ESIC recordsમાં પણ જોવા મળે છે અને જાન્યુઆરી 2026ના Action on Defaulter recordમાં પણ જોવા મળે છે.
ઉદાહરણ તરીકે Sarna Lifesciences, Heranba Industries, Vital Laboratories, Best Paper Mills, Meril Life Sciences અને Superform Chemistries જેવા establishmentsના records અલગ-અલગ ESIC snapshotsમાં જોવા મળે છે.
પરંતુ અહીં એક કાયદાકીય રીતે મહત્વની સ્પષ્ટતા જરૂરી છે: એક જ Employer Code અલગ-અલગ Defaulter recordsમાં જોવા મળે છે એટલે આખા સમયગાળા દરમિયાન સતત default રહ્યો હતો એવું આપમેળે સાબિત થતું નથી.
કારણ કે કોઈ particular establishment અંગે—
- default કયા મહિનાનો હતો,
- કેટલી contribution બાકી હતી,
- કેટલી રકમ બાદમાં ભરાઈ,
- interest કેટલું લાગ્યું,
- damages લાગ્યા કે નહીં,
- recovery શરૂ થઈ કે નહીં,
- અને હાલ outstanding શું છે,
તે જાણવા માટે સંબંધિત ESIC orders અને recovery records જોવાના રહેશે.
ESICના Revenue Manualમાં Defaulter List માટે Defaulter Period, Amount Due, Defaulter Amount અને Status/Remarks જેવા fieldsનો ઉલ્લેખ છે. એટલે માત્ર નામ જોઈને આખી નાણાકીય સ્થિતિ નક્કી કરી શકાય નહીં.
ESIC કાયદો શું કહે છે?
ESI Act હેઠળ contributionની ચુકવણી employerની કાયદેસર જવાબદારી સાથે જોડાયેલી છે. ESICની સત્તાવાર માર્ગદર્શિકા મુજબ હાલ કુલ contribution 4% છે—જેમાં employerનો હિસ્સો 3.25% અને employeeનો હિસ્સો 0.75% છે. Contribution સામાન્ય રીતે સંબંધિત calendar month પૂરો થયા પછી 15 દિવસની અંદર ચૂકવવાની હોય છે.
મોડું payment થાય તો ESI Actની Section 39 હેઠળ interestની જોગવાઈ છે. કાયદામાં 12% વાર્ષિક simple interestની જોગવાઈ દર્શાવવામાં આવી છે, subject to the statutory framework.
તે ઉપરાંત Section 85-B હેઠળ contribution અથવા અન્ય payable amount ન ચૂકવવાના કિસ્સામાં damagesની જોગવાઈ છે, પરંતુ તે ચોક્કસ કેસના records અને લાગુ નિયમો અનુસાર નક્કી થવાની બાબત છે.
ESICના Revenue Manualમાં delayed payment માટે interest/damagesની પ્રક્રિયા અને C-18 તથા ત્યારબાદ C-19 recovery certificateની પ્રક્રિયાનો પણ ઉલ્લેખ છે.
આથી તપાસનો મુદ્દો માત્ર એટલો નથી કે— “કંપનીનું નામ Defaulter Listમાં છે કે નહીં?” પરંતુ સાચા સવાલો છે:
- 1. કેટલા રૂપિયાની contribution બાકી હતી?
- 2. કયા મહિનાઓ/સમયગાળાની હતી?
- 3. Employer અને Employee contributionનો હિસ્સો કેટલો હતો?
- 4. Interest કેટલું વસૂલવાનું હતું?
- 5. Damages લાગ્યા હતા કે નહીં?
- 6. Section 45-A હેઠળ determination order થયો હતો કે નહીં?
- 7. C-18 notice અથવા demand ક્યારે આપવામાં આવી?
- 8. C-19 / recovery certificate જારી થયો હતો કે નહીં?
- 9. કંપનીએ બાદમાં payment કર્યું હતું કે નહીં?
- 10. અને સૌથી મહત્વનું—આજે આ Employer Code સામે ખરેખર કેટલી રકમ outstanding છે?
“નામ બડે, દર્શન છોટે?” — હવે સવાલ દસ્તાવેજોનો
દક્ષિણ ગુજરાતની ઘણી જાણીતી કંપનીઓ CSR, સમાજ સેવા, employee welfare અને corporate responsibility સાથે જોડાયેલી પ્રવૃત્તિઓ કરતી હોય છે.
પરંતુ જ્યારે કોઈ establishmentનું નામ ESICના સત્તાવાર Defaulter/Action on Defaulter recordમાં જોવા મળે ત્યારે એક સ્વાભાવિક જાહેર પ્રશ્ન ઊભો થાય છે:
કંપનીની statutory social-security complianceની વાસ્તવિક સ્થિતિ શું છે?
આ પ્રશ્ન કોઈ કંપનીને દોષિત ઠેરવવાનો નથી. આ સરકારી રેકોર્ડમાં દેખાતા entry પાછળની સંપૂર્ણ હકીકત શોધવાનો પ્રશ્ન છે.
⚠️ મહત્વની કાયદાકીય નોંધ
ESICની Defaulter List અથવા Action on Defaulter recordમાં કોઈ establishmentનું નામ જોવા મળવું પોતે જ fraud, ગેરરીતિ, cheating અથવા કર્મચારીઓના પૈસા ગેરકાયદેસર રીતે રોકવામાં આવ્યા હોવાનો પુરાવો નથી.
તે જ રીતે માત્ર આ public record પરથી હાલની outstanding amount પણ નક્કી કરી શકાય નહીં.
એટલે Auranga Times આ તબક્કે કોઈ establishment અંગે બિનચકાસેલી બાકી રકમ, fraudનો આરોપ કે સતત defaultનો નિષ્કર્ષ રજૂ કરતું નથી.

જો કોઈ establishmentએ બાકી contribution બાદમાં ચૂકવી દીધી હોય, તો paymentની તારીખ અને recovery status પણ તપાસનો ભાગ રહેશે.
કારણ કે Defaulter Listમાં નામ દેખાવું એક સવાલ છે; પરંતુ તે સવાલનો સાચો જવાબ ESICના મૂળ દસ્તાવેજોમાં જ મળશે.
